NY Governor Signs Enhanced BOTS Bill
This week New York Governor Andrew M. Cuomo signed legislation making it illegal to resell tickets obtained by using ticket purchasing software, more commonly referred to as BOTS. The law also creates new penalties for anyone using BOTS to manipulate systems designed to limit the number of tickets to an event that an individual can buy, as well as those who resell tickets knowing they were obtained via the use of BOTS. Governor Cuomo stated that the use of BOTS is “predatory, it’s wrong and, with this legislation, we are taking an important step towards restoring fairness and equity back to this multi-billion dollar industry.”
New York Attorney General Eric T. Schneiderman, a vocal opponent of using BOTS to obtain tickets, added "I was honored to work with Governor Cuomo, Lin-Manuel Miranda, Assemblyman Crespo, and Senator Lanza and to pass this new law which will go a long way to finally bringing sanity--and fairness--to the ticket buying process."
It's also important to note that this new legislation expands the definition of ticket purchasing software to include the wide variety of systems used to quickly amass tickets before the general public can access them. It establishes penalties not just for the use of BOTS, but also for anyone who resells tickets they know were obtained through the use of BOTS. The law also establishes a class A misdemeanor for using BOTS, maintaining an interest in or control of BOTS, and reselling tickets knowingly obtained with BOTS. Violators could face substantial fines and imprisonment.
StubHub has long been a proponent of a fair, secure and competitive ticket marketplace and supports anti-BOTS legislation that is substantive and inclusive of the range of issues impacting fans’ access to tickets. We firmly believe that fans have the right to decide how – and for how much – tickets will be bought and sold after the initial purchase. StubHub is fully committed to partnering with industry, public policy and other leaders to achieve this important goal.
